FAMILY LAW

Separation
Catherine Henry Partners can assist you to negotiate the best possible outcome for you and your family following separation. We have a strong track record in settling matters quickly and efficiently to allow clients to move on to the next phase of their lives with dignity and optimism.

The legal process of ending a marriage or de facto relationship will often have a range of financial and emotional consequences. We work closely with other advisors to assist you to manage the emotional impacts and to ensure that your legal negotiations are informed by sound financial planning for your future.

Property disputes
Catherine Henry Partners takes a practical no nonsense approach to dealing with property disputes, striving for early resolution, with litigation a last resort. Our team is skilled at identifying hidden assets and ensuring that you receive a fair result.

Division of assets
Catherine Henry Partners can assist with the division of assets following a relationship breakdown. Whilst most people understand and can identify their real property assets, they often underestimate the value of other joint assets such as business interests, superannuation entitlements, tax refunds due to a party or debts owed by third parties. We can assist you through the property settlement process and also alert you to liabilities and other financial resources.

Grandparents' interests
Catherine Henry Partners can assist with protecting and enforcing your rights in this area. As people significant to a child’s welfare and development, grandparent’s interests are recognised under the law. Unfortunately, many grandparents become carers of their grandchildren due to the inability of their children to fulfil their roles as parents. Catherine Henry Partners provides legal advice, representation and support to Grandparents who are forced to negotiate the family law system.

Conflict Resolution and Mediation
We have a demonstrated commitment to using conflict resolution to achieve sustainable outcomes for family law clients. The Family Law Act requires all parties in a dispute about children to attend mediation before going to Court unless there are family violence or other issues. Catherine Henry Partners can organise a mediation conference with your ex-partner or other parties and attend mediation with you to provide support and legal advice about your proposed agreement. Mediation may not resolve all the issues but it can save you time and money by reaching agreement on some issues.

Court Representation
We aim to secure the best outcomes for clients quickly and efficiently. This means that we end up settling most matters without going to Court. However, for those clients which do require representation in Court we can assist you with preparing documents, representation at Court and negotiating the Court system. We have a strong track record in providing sound advice to our clients to get sustainable results for them and their families.

Dealing with Government Agencies
We are experienced in dealing with a range of government agencies working with families including the Child Support Agency, the Family Assistance Office, Centrelink and the Guardianship Tribunal. We can ensure that you receive any benefits to which you are entitled as a result of your family responsibilities. In addition, our knowledgeable team can make sure any assessments about your responsibilities as a child support payer are properly calculated.

Pre-nuptial agreements
Catherine Henry Partners can assist you and your partner with sensible pre-nuptial agreements to ensure both parties interests are protected in a positive way.

Spousal maintenance
We can assist you with pursuing or meeting your obligations under spousal maintenance arrangements. Many people do not realise that spousal maintenance is not automatic, and often needs to be pursued legally.
